- I will meet with the detained client at the earliest opportunity, explain the nature of the case, provide legal counseling, and clearly advise on all rights available under Chinese law.
- I will apply for bail pending trial or seek alternative compulsory measures, striving to prevent the client from remaining in pre-trial detention throughout the proceedings.
- During the police investigation and procuratorate review stages, I will submit written legal opinions to pursue case dismissal or non-prosecution where evidence is insufficient or the offense is minor.
- If coercive interrogation, induced confessions, or procedural violations occur during the investigation, I will file complaints or accusations on the client's behalf.
- Before the procuratorate decides whether to approve arrest, I will personally communicate with the prosecutor and submit arguments against arrest, striving to keep the client out of custody.
- If arrest has already been approved, I will continue to apply for detention necessity review, compelling the authorities to reassess whether continued detention is justified.
- With the client's voluntary consent, I will engage in sentencing negotiations with the prosecutor to secure the most favorable sentencing recommendation possible.
- In all legally permissible circumstances – including insufficient evidence, minor offenses, or statutory exemptions – I will vigorously pursue a non-prosecution decision from the procuratorate.
- I will proactively gather leads and identify evidence obtained through illegal means, striving to have such evidence excluded at pretrial conferences.
- I will apply for pretrial conferences to clarify disputed issues and formulate defense strategies; during trial, I will deliver oral defense arguments and maintain necessary communication with the presiding judge.
- Our services extend to first-instance trials, second-instance appeals, and defense representation during the death penalty review stage.
- If new evidence emerges or the final judgment is found to be erroneous, I will pursue a retrial through the court or apply to the procuratorate for a prosecutorial protest.
